Office of profit is a position that brings or has the potential to bring the person holding it financial gain. Under the Indian constitution (Articles 102 and 191), holding an office of profit by a legislator is not allowed. Holding the office of profit can lead to the disqualification of said legislator (MP or MLA). There are also several constitutional and legal exceptions to the definition of office of profit.

What is an office of Profit?

An office of profit generally refers to a position that brings or has the potential to bring to the person holding it some financial gain, advantage, or benefit.

  • Various constitutions of the world mention the term to showcase executive appointments, which are not allowed. 
  • Various countries in the world disqualify members of the legislature for accepting an office of profit under the executive. It is a means to secure the independence of the legislature and preserve the separation of powers.
  • If MPs and MLAs hold an ‘office of profit’ under the government, they might come under the government’s influence. This may hamper their ability to carry out the constitutional responsibility of legislative accountability, which is the hallmark of parliamentary democracy.

Criteria for Determining Office of Profit

Factors that are considered in the determination of office of profit are as follows:

  • Whether the union or state government is the appointing authority for the office
  • Whether the union or state government has the power to terminate the appointment to the office
  • Whether the union or state government determines the remuneration of that office
  • What is the source of remuneration of that office
  • What are the powers that come with the position

Office of Profit and Constitution

The disqualification criteria for a Member of Parliament and a Member of the legislative assembly are laid down in Articles 102 and 191 of the Indian Constitution, respectively.

  • These articles provide that a member will be disqualified from being an MP or MLA if they hold an office of profit.
  • Articles 102 and 191 also state that “a person shall not be deemed to hold an office of profit under the government of India or the government of any state by reason only that he is a minister”.
  • Provisions under Articles 102 and 191 also protect a legislator occupying a government position if that particular office has been made immune to disqualification by the law of parliament. In this regard, Parliament has enacted the Parliament (Prevention of Disqualification) Act, 1959, to make certain positions immune from disqualification.

Article 102 of the Indian constitution

Disqualifications for membership

(1) A person shall be disqualified for being chosen as, and for being, a member of either House of Parliament

(a) if he holds any office of profit under the Government of India or the Government of any State, other than an office declared by Parliament by law not to disqualify its holder;

The article also provides that such disqualification can’t be on the grounds of holding the post of minister in the union government. The article also provides other criteria for disqualification of a member of parliament.

(1) A person shall be disqualified for being chosen as, and for being, a member of the Legislative Assembly or Legislative Council of a State

(a) if he holds any office of profit under the Government of India or the Government of any State specified in the First Schedule, other than an office declared by the Legislature of the State by law not to disqualify its holder;

The article also provides that such disqualification can’t be on the grounds of holding the post of minister in the state government. The article also provides other criteria for disqualification for a member of the state legislature.

The purpose of having the concept of office of profit is to have a separation of powers between the legislative and executive branches of the government. The issue of the parliamentary secretary shows that several governments are utilizing techniques to give government posts to their MLAs, which threatens the legislative accountability of parliamentary democracy.

What constitutes an office of profit is not defined by constitution and it is parliament's authority to decide by law what is an office of profit.

The constitution clarifies under Articles 102 and 191 that the post of minister will not be considered an office of profit. The Parliament (Prevention of Disqualification) Act, 1959 also provides various exceptions to the office of profit.
